These Terms & Conditions (“Terms”) govern your access to and use of the AquaGuard water-safety platform, including the website at aquaguardclean.com, the AquaGuard mobile applications, and any related services (together, the “Service”), operated by Badexy Technologies, LLC (“AquaGuard”, “we”, “us”, or “our”).
By creating an account, or by accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
1. About AquaGuard
AquaGuard is a platform for verifying bottled and sachet drinking-water products, distributing product recall and safety alerts, allowing consumers to report suspected quality issues, and giving regulators, manufacturers, distributors, and retailers tools to manage product-safety information. Different features are available to different account roles.
2. Eligibility
You must be at least 18 years old to create an account. By using the Service you represent that you meet this requirement and that any information you provide is accurate and current. Operator accounts (regulator, manufacturer, distributor, retailer, administrator) are intended for use by authorised representatives of the relevant organisation.
3. Accounts and security
- Some features (verification and viewing public safety information) are available without an account. Others - submitting reports, subscribing to alerts, and all operator portals - require you to sign in.
- You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at info@badexytechnologies.com of any unauthorised use.
- You must not share, sell, or transfer your account, or create an account using false information or on behalf of another person or organisation without authorisation.
- We may seed, provision, suspend, or revoke operator and administrator accounts at our discretion or at the direction of the relevant organisation or authority.
4. Product verification - important limitations
The verification feature returns information held in the AquaGuard registry about a product code (for example an authenticity status, inspection history, or a recall notice). You acknowledge that:
- Verification is informational only and is not a guarantee of a product’s safety, authenticity, fitness for consumption, or compliance with any law or standard.
- A result of “safe”, “not found”, “suspect”, “counterfeit”, or “recalled” reflects the data available to us at the time and may be incomplete, delayed, or inaccurate.
- Offline results may be out of date. When your device is offline, the Service may show a previously cached result, clearly marked as such, which may not reflect the latest recalls or status changes.
- A “not found” result does not by itself mean a product is counterfeit or unsafe, and a “safe” result does not mean a product is guaranteed safe.
- The Service is not a substitute for professional, medical, laboratory, or regulatory advice. Do not rely on it alone for decisions affecting health or safety. If you believe a product is unsafe, stop using it and contact the appropriate health or regulatory authority.
5. Alerts and notifications
If you subscribe to recall alerts (by email) or enable push notifications (in the mobile app), you consent to receiving safety-related messages. Delivery depends on third-party networks and providers and cannot be guaranteed - messages may be delayed, filtered, or fail to arrive. You can unsubscribe from email alerts at any time in the app, and disable push notifications in your device settings. You may still receive essential service messages relating to your account.
6. Consumer reports and user content
If you submit a report or other content (“User Content”) - for example a suspected quality issue, brand name, location, or product code - you represent that the information is truthful, accurate, and submitted in good faith; that you have the right to share it; and that it is not knowingly false, misleading, defamatory, or intended to damage a competitor.
You retain ownership of your User Content. You grant AquaGuard a worldwide, non-exclusive, royalty-free licence to store, process, display, and share that content for the purposes of operating the Service, including routing reports and safety signals to regulators and other authorised parties. Reports and the signals derived from them may be reviewed by regulatory authorities and may inform enforcement action. We may moderate, decline, or remove User Content but are not obliged to review or act on any submission.
7. Obligations of operator accounts
If you hold a regulator, manufacturer, distributor, retailer, or administrator role, you agree that you are authorised to act for your organisation and that any product data, inspection records, recalls, verdicts, consignment records, role assignments, or enforcement actions you enter are accurate, lawful, and within your authority. You are responsible for the consequences of information you publish through the Service, including recalls and verdict changes shown to consumers.
8. Acceptable use
You agree not to:
- use the Service for any unlawful, fraudulent, or harmful purpose;
- submit false product information, fake reports, or fabricated recalls;
- attempt to gain unauthorised access to any account, role, data, or system, or bypass authentication, role restrictions, or rate limits;
- interfere with, overload, disrupt, scrape, or reverse-engineer the Service, or probe it for vulnerabilities except under a programme we have authorised in writing;
- use the Service to harass, defame, or damage any person or business, or misrepresent your identity, role, or affiliation.
We may investigate and take appropriate action, including suspending or terminating access and reporting to authorities, for any suspected violation.
9. Intellectual property
The Service, including its software, design, text, graphics, and the AquaGuard name and logos, is owned by AquaGuard or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or create derivative works except as expressly permitted.
10. Third-party services
The Service relies on third-party providers (for example hosting, email delivery, and push-notification networks). We are not responsible for the availability, performance, or acts of those third parties, and your use of any third-party service is subject to that provider’s own terms.
11. Availability
We aim to keep the Service available but do not guarantee uninterrupted, timely, secure, or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice.
12. Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or that safety information is complete or current, to the fullest extent permitted by law.
13. Limitation of liability
To the fullest extent permitted by law, AquaGuard and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or for personal injury or illness, arising out of or relating to your use of, or inability to use, the Service or reliance on any verification result, recall, alert, or other information - even if advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded. Subject to the foregoing, our total aggregate liability arising out of or relating to the Service will not exceed USD 100, or the total amount (if any) you paid us for the Service in the 12 months before the claim, whichever is greater.
14. Indemnification
You agree to indemnify and hold harmless AquaGuard from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your breach of these Terms or of any law or third-party right.
15. Suspension and termination
We may suspend or terminate your access at any time for any breach of these Terms or where we reasonably believe it is necessary to protect the Service, other users, or the public. You may stop using the Service and request deletion of your account at any time (see the Privacy Policy). Sections that by their nature should survive termination (including 6, 9, 12, 13, and 14) will survive.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will take reasonable steps to notify you (for example by posting the updated Terms with a new effective date or by email). Your continued use of the Service after changes take effect constitutes acceptance.
17. Governing law and disputes
These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict-of-law rules. The state and federal courts located in the State of Alabama, United States will have exclusive jurisdiction over any dispute, except where mandatory local law gives you the right to bring proceedings elsewhere.
